abilityX® is a trademark of HandicapX GmbH, which also operates the abilityX® App. The abilityX® Android App and the abilityX® iPhone App are collectively referred to as „abilityX App“ or „Application“ throughout this document.
As a service provider, we are responsible for our own content, which we make available for use, in accordance with the general laws pursuant to Section 7 (1) TMG. According to §§ 8 to 10 TMG, however, we are not obligated as a service provider to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information under the general laws remain unaffected. Our application contains third-party toilet locations over whose availability, accessibility and usability we have no control. Therefore, we cannot assume any liability for the toilet locations. The respective provider or operator is always responsible for the availability, accessibility and usability of these toilet locations. The registered toilet locations were checked for possible legal violations at the time of entry into the database. At the time of entry, no illegalities were apparent. However, a permanent control of the toilet locations is not reasonable without concrete evidence of a violation. If we become aware of any infringements, we will remove such entries immediately.

The abilityX® App, its content, design and presentation are subject to German copyright law. Reproduction, distribution, decompilation and any kind of exploitation beyond the limits of copyright law require the express written consent of HandicapX GmbH. Downloads of this application are only permitted for private, non-commercial use.
Where content within this app was not created by the operator, the copyrights of third parties are respected and marked accordingly. Should you become aware of a copyright infringement, please notify us. Upon becoming aware of any such violations, we will remove the relevant content immediately.
HandicapX GmbH reserves the right to make changes to the abilityX® App at any time. Such changes do not necessarily require an update and may, to a certain extent, be applied server-side.
The accessibility of the abilityX App cannot be guaranteed permanently. The operator of the application reserves the right to discontinue the abilityX App at any time without notice and justification.
The protection of your personal data is a close concern to us. In this sense, we undertake to treat your data confidentially, not to pass it on to third parties and to protect it from unauthorized access by third parties. All entries made by the user in the context of feedback in the abilityX app are voluntary and serve us exclusively for the purpose of correspondence. All transmitted data in the context of processing, reports, evaluation and commenting on the toilet locations are treated confidentially and made available anonymously.
The abilityX App in the Android version uses Google Maps, a service provided by Google Inc („Google“). The use of Google Maps and the information obtained via Google Maps is subject to the Google Terms of Use and the additional terms and conditions for Google Maps. The use of Google Maps is solely for the determination of your current location, the geo-coordination of toilet locations as well as their display on the Google Maps via the Google Maps API in accordance with the terms and conditions for the Google Maps API to.
The abilityX App in the iOS version uses Apple Maps, a service provided by Apple Inc („Apple“). The use of Apple Maps and the information obtained through Apple Maps is subject to Apple’s Terms of Use and the Additional Terms of Service for Apple Maps. The use of Apple Maps is solely for the purpose of determining your current location, geo-coordinating restroom locations and displaying them on Apple Maps via the Apple Maps API in accordance with the terms and conditions for the Apple Maps API.
